Amir bi Sa'd on the authority of his father Sa d bin Abi Waqas هللا تعالی عنہ) (رضئ narrated that when (Sa d) fell ill at Makka (according to the version of Ibn Abi Kkalaf), then the agreed version has, which brought him near to death, the Apostle of Allah هللا عليه و آله وسلم) (صلى visited him. He said, Apostle of Allah هللا تعالی عنہ),(رضئ I have a large property, and my daughter is my only heir. May I give two-thirds (of my property) as a sadaqah (charity)? He said, no. He asked, Then a half. He replied, no. He asked, Then one-third? He replied, (you may will away) a third, and third is a lot. To leave your heirs rich is better than to leave them poor begging from people. You will not spend anything, seeking thereby to please Allah, without being rewarded for it, even the mouthful you give your wife. I said, Apostle of Allah هللا عليه و آله وسلم),(صلى shall I be left behind from immigration (to Madina)? He said, if you remain behind after me and do good works seeking the pleasure of Allah, your rank will be raised and degree increased. Perhaps you will not remain behind, and some people will benefit from you and others will be harmed by you. He then said, O Allah, complete the immigration of my Companions and do not turn them back. But miserable was Sa'd bin Khawlah. The Apostle of Allah هللا عليه و آله وسلم) (صلى was grieved as he died at Makka. He,(صلى هللا عليه و آله وسلم) Apostle of Allah,(وسلم which you give something as sadaqah (charity) when you are healthy, greedy, expect survival and fear poverty, and not that you postpone it until your death and then you say, for so-and-so is such-and-such, and for so-and-so is such-and-such, while it was already for so-and-so. Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 005 ح د ث ن ا أ ح م د ب ن ص ال ح ح د ث ن ا اب ن أ ب ي ف د ي ك أ خ ب ر ن ي اب ن أ ب ي ذ ئ ب ع ن ش ر ح ب يل ع ن أ ب ي س ع يد ال خ د ر ي أ ن ر س ول للا صلى هللا عليه وسلم ق ال " أل ن ي ت ص د ق ال م ر ء ف ي ح ي ات ه ب د ر ه م خ ي ر ل ه م ن أ ن ي ت ص د ق ب م ائ ة ع ن د م و ت ه ". Abu Sa'id al-khudri هللا تعالی عنہ) (رضئ narrated that the Prophet هللا عليه و آله وسلم) (صلى said, a man giving a dirham as sadaqah (charity) during his life is better than giving one hundred dirhams as sadaqah (charity) at the time of death. Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 006 ح د ث ن ا ع ب د ة ب ن ع ب د للا أ خ ب ر ن ا ع ب د الص م د ح د ث ن ا ن ص ر ب ن ع ل ي ال ح د ان ي ح د ث ن ا األ ش ع ث ب ن ج اب ر ح د ث ن ي ش ه ر ب ن ح و ش ب أ ن أ ب ا ه ر ي ر ة ح د ث ه أ ن ر س ول للا صلى هللا عليه وسلم ق ا ل " إ ن الر ج ل ل ي ع م ل و ال م ر أ ة ب ط اع ة للا س ت ين س ن ة ث م ي ح ض ر ه م ا ال م و ت ف ي ض ار ان ف ي ال و ص ي ة ف ت ج ب ل ه م ا الن ار ". ق ال و ق ر أ ع ل ى أ ب و ه ر ي ر ة م ن ه ا ه ن ا { م ن ب ع د و ص ي ة ي وص ى ب ه ا أ و د ي ن غ ي ر م ض ار } ح ت ى ب ل غ { ذ ل ك ال ف و ز ال ع ظ يم }. ق ال أ ب و د او د ه ذ ا - ي ع ن ي األ ش ع ث ب ن ج اب ر - ج د ن ص ر ب ن ع ل ي. Abu Hurayrah هللا تعالی عنہ) (رضئ narrataed that the Prophet هللا عليه و آله وسلم) (صلى said, a man or a woman acts in obedience to Allah for sixty years, then when they are about to die they cause م ن - recited (رضئ هللا تعالی عنہ) injury by their will, so they must go to Hell. Then Abu Hurayrah [After a legacy which you bequeath or a debt], causing no injury ب ع د و ص ي ة ي وص ى ب ه ا أ و د ي ن غ ي ر م ض ار success]. [that will be the mighty ذ ل ك ال ف و ز ال ع ظ يم - Imam Abu Dawood said, Al-Ash'ath bin Jabir is the grandfather of Nasr bin Ali. 3
CHAPTER (4) باب م ا ج اء ف ي الد خ ول ف ي ال و ص اي ا What has been related about accepting the position of executing a Will Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 007 ح د ث ن ا ال ح س ن ب ن ع ل ي ح د ث ن ا أ ب و ع ب د الر ح م ن ال م ق ر ئ ح د ث ن ا س ع يد ب ن أ ب ي أ ي وب ع ن ع ب ي د للا ب ن أ ب ي ج ع ف ر ع ن س ال م ب ن أ ب ي س ال م ال ج ي ش ان ي ع ن أ ب يه ع ن أ ب ي ذ ر ق ال ق ال ل ي ر س ول للا صلى هللا عليه وسلم " ي ا أ ب ا ذ ر إ ن ي أ ر اك ض ع يف ا و إ ن ي أ ح ب ل ك م ا أ ح ب ل ن ف س ي ف ال ت أ م ر ن ع ل ى اث ن ي ن و ال ت و ل ي ن م ال ي ت يم ". ق ال أ ب و د او د ت ف ر د ب ه أ ه ل م ص ر. Abu Dharr هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said to me, Abu Dharr هللا تعالی عنہ),(رضئ I see you weak, and I like for you what I like for myself. Do not be a leader of two (persons), and do not be a guardian of an orphan. Imam Abu Dawud said, this has been narrated only by the people of Egypt. CHAPTER (5) باب م ا ج اء ف ي ن س خ ال و ص ي ة ل ل و ال د ي ن و األ ق ر ب ين What has been related about abrogating the will for the parents and near relatives Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 008 ح د ث ن ا أ ح م د ب ن م ح م د ال م ر و ز ي ح د ث ن ي ع ل ي ب ن ح س ي ن ب ن و اق د ع ن أ ب يه ع ن ي ز يد الن ح و ي ع ن ع ك ر م ة ع ن اب ن ع ب اس { إ ن ت ر ك خ ي ر ا ال و ص ي ة ل ل و ال د ي ن و األ ق ر ب ين } ف ك ان ت ال و ص ي ة ك ذ ل ك ح ت ى ن س خ ت ه ا آي ة ال م ير ا ث. إ ن ت ر ك خ ي ر ا ال و ص ي ة ل ل و ال د ي ن - describes narrated that the Qur'anic verse (رضئ هللا تعالی عنہ) Ibn Abbas [It is prescribed when death approaches any of you), if he leaves any goods, that he may و األ ق ر ب ين bequest to parents and next to kin]. The bequest was made in this way until the verse of inheritance repealed it. 4
CHAPTER (6) باب م ا ج اء ف ي ال و ص ي ة ل ل و ار ث What has been related about making a will for an heir Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 009 ح د ث ن ا ع ب د ال و ه اب ب ن ن ج د ة ح د ث ن ا اب ن ع ي اش ع ن ش ر ح ب يل ب ن م س ل م س م ع ت أ ب ا أ م ام ة س م ع ت ر س ول للا صلى هللا عليه وسلم ي ق ول " إ ن للا ق د أ ع ط ى ك ل ذ ي ح ق ح ق ه ف ال و صي ة ل و ار ث ". (صلى هللا عليه و آله وسلم) narrated that he heard the Apostle of Allah (رضئ هللا تعالی عنہ) Abu Hurayrah say, Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir. CHAPTER (7) باب م خ ال ط ة ال ي ت يم ف ي الط ع ام Mixing the provisions with the provisions of the Orphan Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 010 ح د ث ن ا ع ث م ان ب ن أ ب ي ش ي ب ة ح د ث ن ا ج ر ير ع ن ع ط اء ع ن س ع يد ب ن ج ب ي ر ع ن اب ن ع ب اس ق ال ل م ا أ ن ز ل للا ع ز و ج ل { و ال ت ق ر ب وا م ال ال ي ت يم إ ال ب ال ت ي ه ي أ ح س ن } و { إ ن ال ذ ين ي أ ك ل ون أ م و ال ال ي ت ام ى ظ ل م ا } اآلي ة ان ط ل ق م ن ك ان ع ن د ه ي ت يم ف ع ز ل ط ع ام ه م ن ط ع ام ه و ش ر اب ه م ن ش ر اب ه ف ج ع ل ي ف ض ل م ن ط ع ام ه ف ي ح ب س ل ه ح ت ى ي أ ك ل ه أ و ي ف س د ف اش ت د ذ ل ك ع ل ي ه م ف ذ ك ر وا ذ ل ك ل ر س ول للا صلى هللا عليه وسلم ف أ ن ز ل للا ع ز و ج ل { و ي س أ ل ون ك ع ن ال ي ت ام ى ق ل إ ص ال ح ل ه م خ ي ر و إ ن ت خ ال ط وه م ف إ خ و ان ك م } ف خ ل ط وا ط ع ام ه م ب ط ع ام ه و ش ر اب ه م ب ش ر اب ه. و ال - verses revealed the (ع ز و ج ل ( Allah narrated that when (رضئ هللا تعالی عنہ) Abdullah ibn Abbas [ Come not nigh to the orphan's property except to improve it]. And ت ق ر ب وا م ال ال ي ت يم إ ال ب ال ت ي ه ي أ ح س ن [Those who unjustly eat up the property of orphans], everyone who إ ن ال ذ ين ي أ ك ل ون أ م و ال ال ي ت ام ى ظ ل م ا had an orphan with him went and separated his food from his (orphan's) food, and his drink from his drink, and began to detain the remaining food which he (the orphan) himself ate or spoiled..(صلى هللا عليه و آله وسلم) This fell heavy on them, and they mentioned this to the Apostle of Allah So, Allah ( ز و ج ل ( revealed the verse - و ي س أ ل ون ك ع ن ال ي ت ام ى ق ل إ ص ال ح ل ه م خ ي ر و إ ن ت خ ال ط وه م ف إ خ و ان ك [They ask you concerning orphans. Say, the best thing to do is what is for their good; if you mix their 5
affairs with yours, they are your brethren]. Then they mixed their food with his food and their drink with his drink. CHAPTER (8) باب م ا ج اء ف يم ا ل و ل ي ال ي ت يم أ ن ي ن ال م ن م ال ال ي ت يم What has been related about what is allowed for the guardian of the orphan to take from the Orphan s wealth Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 011 ح د ث ن ا ح م ي د ب ن م س ع د ة أ ن خ ال د ب ن ال ح ار ث ح د ث ه م ح د ث ن ا ح س ي ن - ي ع ن ي ال م ع ل م - ع ن ع م ر و ب ن ش ع ي ب ع ن أ ب يه ع ن ج د ه أ ن ر ج ال أ ت ى الن ب ي صلى هللا عليه وسلم ف ق ال إ ن ي ف ق ير ل ي س ل ي ش ى ء و ل ي ي ت ي م. ق ال ف ق ال " ك ل م ن م ال ي ت يم ك غ ي ر م س ر ف و ال م ب اد ر و ال م ت أ ث ل ". Amr bin Suh'aib narrated from his father that his grandfather told that a man came to the Prophet and said, I am poor, I have nothing (with me), and I have an orphan. He (صلى هللا عليه و آله وسلم ( said, use the property of your orphan without spending it lavishly, hurrying and taking it as your own property. CHAPTER (9) باب م ا ج اء م ت ى ي ن ق ط ع ال ي ت م What has been related about when one ceases to be an Orphan Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 012 ح د ث ن ا أ ح م د ب ن ص ال ح ح د ث ن ا ي ح ي ى ب ن م ح م د ال م د ين ي ح د ث ن ا ع ب د للا ب ن خ ال د ب ن س ع يد ب ن أ ب ي م ري م ع ن أ ب يه ع ن س ع يد ب ن ع ب د الر ح م ن ب ن ي ز يد ب ن ر ق ي ش أ ن ه س م ع ش ي وخ ا م ن ب ن ي ع م ر و ب ن ع و ف و م ن خ ال ه ع ب د للا ب ن أ ب ي أ ح م د ق ال ق ال ع ل ي ب ن أ ب ي ط ال ب ح ف ظ ت ع ن ر س ول للا صلى هللا عليه وسلم " ال ي ت م ب ع د اح ت ال م و ال ص م ات ي و م إ ل ى الل ي ل ". Ali ibn AbuTalib هللا تعالی عنہ) (رضئ narrated that he memorized (a tradition) from the Apostle of Allah هللا عليه و آله وسلم).(صلى The Prophet هللا عليه و آله وسلم) (صلى said, there is no orphanhood after puberty, and there is no silence for the whole day till the night. 6
CHAPTER (10) باب م ا ج اء ف ي الت ش د يد ف ي أ ك ل م ال ال ي ت يم What has been related about the severity of consuming the wealth of an Orphan Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 013 ح د ث ن ا أ ح م د ب ن س ع يد ال ه م د ان ي ح د ث ن ا اب ن و ه ب ع ن س ل ي م ان ب ن ب ال ل ع ن ث و ر ب ن ز ي د ع ن أ ب ي ال غ ي ث ع ن أ ب ي ه ر ي ر ة أ ن ر س ول للا صلى هللا عليه وسلم ق ال " اج ت ن ب وا الس ب ع ال م وب ق ات ". ق يل ي ا ر س ول للا و م ا ه ن ق ا ل " الش ر ك ب ا لل و الس ح ر و ق ت ل الن ف س ال ت ي ح ر م للا إ ال ب ال ح ق و أ ك ل الر ب ا و أ ك ل م ال ال ي ت يم و الت و ل ي ي و م الز ح ف و ق ذ ف ال م ح ص ن ات ال غ اف ال ت ال م ؤ م ن ا ت ". ق ال أ ب و د او د أ ب و ال غ ي ث س ال م م و ل ى اب ن م ط يع. Abu Hurairah هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, refrain from seven (characteristics) which cause destruction. He was asked, what are they, Apostle of Allah هللا عليه و آله وسلم)?(صلى He replied, To assign partner to Allah, magic, to kill a soul (man) which is prohibited by Allah except for which is due, to take usury, to consume the property of an orphan, to retreat on the day of the battle, and to slander chaste women, indiscreet but believing. Imam Abu Dawood said, the name Abu Al-Ghaith is Salim, client of Ibn Muti'. Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 014 ح د ث ن ا إ ب ر اه يم ب ن ي ع ق وب ال ج وز ج ان ي ح د ث ن ا م ع اذ ب ن ه ان ئ ح د ث ن ا ح ر ب ب ن ش د اد ح د ث ن ا ي ح ي ى ب ن أ ب ي ك ث ير ع ن ع ب د ال ح م يد ب ن س ن ان ع ن ع ب ي د ب ن ع م ي ر ع ن أ ب يه أ ن ه ح د ث ه - و ك ان ت ل ه ص ح ب ة - أ ن ر ج ال س أ ل ه ف ق ال ي ا ر س ول للا م ا ال ك ب ائ ر ف ق ال " ه ن ت س ع ". ف ذ ك ر م ع ن اه ز اد " و ع ق وق ال و ال د ي ن ال م س ل م ي ن و اس ت ح ال ل ال ب ي ت ال ح ر ام ق ب ل ت ك م أ ح ي اء و أ م و ات ا ". Umair هللا تعالی عنہ) (رضئ narrated that a man asked, Apostle of Allah هللا عليه و آله وسلم),(صلى what are the grave sins? He replied, they are nine. He then mentioned the tradition to the same effect (as above). But this version adds, and disobedience to the Muslim parents, and to violate the sacred House, your Qiblah, in your life and after death. CHAPTER (11) 7
باب م ا ج اء ف ي الد ل يل ع ل ى أ ن ال ك ف ن م ن ج م يع ال م ال What has been related about the shroud is from one s own wealth Sunan Abu Dawood, Vol 3, Bk 18, Hadith # 015 ح د ث ن ا م ح م د ب ن ك ث ير أ خ ب ر ن ا س ف ي ان ع ن األ ع م ش ع ن أ ب ي و ائ ل ع ن خ ب اب ق ال م ص ع ب ب ن ع م ي ر ق ت ل ي و م أ ح د و ل م ت ك ن ل ه إ ال ن م ر ة ك ن ا إ ذ ا غ ط ي ن ا ب ه ا ر أ س ه خ ر ج ت ر ج ال ه و إ ذ ا غ ط ي ن ا ر ج ل ي ه خ ر ج ر أ س ه ف ق ال ر س ول للا صلى هللا عليه وسلم " غ ط وا ب ه ا ر أ س ه و اج ع ل وا ع ل ى ر ج ل ي ه م ن اإل ذ خ ر ". Khabbab هللا تعالی عنہ) (رضئ narrated that Mus'ab bin 'Umar was killed at the battle of Uhud, and for him only a coarse cloth would be found as shroud. When we covered his head, his feet صلى هللا عليه و ( Allah showed, and when we covered his feet, his head showed. He (وسلم your reward became due, and she came back to you in inheritance. She said, she died while a month's fasting was due from her. Would it be sufficient or be taken as completed if I fast on her behalf? He said, yes. She said, she also did not perform Hajj, would it be sufficient or be taken completed if I perform (Hajj) on her behalf? He said, yes. CHAPTER (13) 8

Ibn 'Umar هللا تعالی عنہ) (رضئ narrated that Umar هللا تعالی عنہ) (رضئ got some land in Khaibar and when he informed the Prophet هللا عليه و آله وسلم) (صلى that he has have acquired land in Khaibar which he considered to be more valuable than any of the lands he had, what you command me to do with it? He replied, if you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So Umar هللا تعالی عنہ) (رضئ gave it as a sadaqah declaring that the property must not be sold, given away, or inherited, and gave its produce as sadaqah to the poor relatives, the emancipation of slaves, Allah's path, travelers. The narrator Bishr added, and guests. Then the agreed version goes, no sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. The narrator Bishr added, provided he is not storing-up goods (for himself). Yahya bin Sa'id narrated that Abdul Hamid bin Abdullah bin Abdullah bin Umar bin Al-Khattab copied to me a document about the religious endowment (waqf) made by Umar bin al-khattab which read, In the name of Allah, the Compassionate, the Merciful. This is (رضئ هللا تعالی عنہ ( what Allah's servant Umar هللا تعالی عنہ) (رضئ has written about Thamgh. He narrated the tradition like the one transmitted by Nafi'. He added, provided he is not storing up goods (for himself). The surplus fruit will be devoted to the beggar and the deprived. He then went on with the tradition, saying, if the man in charge of Thamgh wishes to buy a slave for his work for its fruits (by selling them), he may do so. Mu'iqib penned it and 'Abdullah bin Al-Arqam witnessed it: In 9
رضئ هللا ( Umar the name of Allah, the Compassionate, the Merciful. This is what Allah's servant dies), Commander of Faithful, directed, in case of some incident happens to him (he,(تعالی عنہ that Thamg, Sirmah bin al-akwa', the servant who is there, the hundred shares in (the land of) صلى هللا عليه و آله ( Muhammad Khaiber, the servant who is there and the hundred shares which had donated to me in the valley (nearby) will remain in the custody of Ummul Momineen (وسلم Hafsah هللا تعالی عنہا) (رضئ during her life, then the men of opinion from her family will be in charge of these (endowments). These will neither be sold not purchased, spending (its produce) where they think (necessary on the beggar, deprived and relatives). There is no harm to the one in charge (of this endowment) if he eats himself, or feeds, or buys slaves with it. Amr bin Suh'aib narrated from his father that his grandfather told that Al-'As ibn Wa'il left his رضئ هللا تعالی ( Hisham will that a hundred slaves should be emancipated on his behalf. His son intended to emancipate the (رضئ هللا تعالی عنہ) emancipated fifty slaves and his son Amr (عنہ صلى هللا عليه و آله ( Allah remaining fifty on his behalf, but he said, I should ask first the Apostle of صلى هللا ( Allah and said, Apostle of (صلى هللا عليه و آله وسلم ( Prophet He, therefore, came to the.(وسلم my father left in his will that a hundred slaves should be emancipated on his behalf,(عليه و آله وسلم and Hisham هللا تعالی عنہ) (رضئ has emancipated fifty on his behalf and fifty remain. Shall I emancipate them on his behalf? The Apostle of Allah هللا عليه و آله وسلم) (صلى said, had he been a Muslim and you had emancipated slaves on his behalf, or given sadaqah on his behalf, or performed the pilgrimage, that would have reached him. CHAPTER (17) باب م ا ج اء ف ي الر ج ل ي م وت و ع ل ي ه د ي ن و ل ه و ف اء ي س ت ن ظ ر غ ر م اؤ ه و ي ر ف ق ب ال و ار ث What has been related about a man who dies and leaves behind a debt and he has what will fulfill the debt.
