Jabir bin Abdullah هللا تعالی عنہ) (رضئ narrated that a man among us promised freedom to a slave صلى ( Prophet after his death, and he did not have any property other than him (this slave). So, the 1
a man from Banu Adi, bought,(رضئ هللا تعالی عنہ) sold him, and Ibn Nahham (هللا عليه و آله وسلم him. Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Prophet هللا عليه و آله وسلم) (صلى said, the Mudabbar is part of the one third of the estate (which can be taken care off as per his will). Ibn Abbas هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, any man whose slave woman bears him a child, she will be free after he dies. (عليه السالم) narrated that mention was made of the mother of Ibrahim (رضئ هللا تعالی عنہ) Ibn Abbas in the presence of the Apostle of Allah هللا عليه و آله وسلم),(صلى and he said, 'her son has set her free.' Sunan Ibn Majah Vol 3, Bk 19, Hadith # 6 ح د ث ن ا م ح م د ب ن ي ح ي ى و إس ح اق ب ن م ن ص ور ق اال ح د ث ن ا ع ب د الر ز اق ع ن اب ن ج ر ي ج أ خ ب ر ني أ ب و الز ب ي ر أ ن ه س مع ج ابر ب ن ع ب د للا ي ق ول ك ن ا ن بيع س ر ارين ا و أ م ه ات أ و ال دن ا و الن بي صلى هللا عليه وسلم فين ا ح ى ال ن ر ى بذ لك ب أ س ا. Jabir bin Abdullah هللا تعالی عنہ) (رضئ was heard saying that they used to sell their slave women and the mothers of their children when the Prophet هللا عليه و آله وسلم) (صلى was still living among us, and we did not see anything wrong with that. CHAPTER (3) ب اب ال م ك ات ب The Mukatab (A slave who has written agreement with his master that after he pays certain amount within a stipulated period, he will be considered as free Sunan Ibn Majah Vol 3, Bk 19, Hadith # 7 ح د ث ن ا أ ب و ب ك ر ب ن أ بي ش ي ب ة و ع ب د للا ب ن س عيد ق اال ح د ث ن ا أ ب و خ الد األ ح م ر ع ن اب ن ع ج ال ن ع ن س عيد ب ن أ بي س عيد ع ن أ بي ث ال ث ة ك ل ه م ح ق ع ل ى للا ع و ن ه ال غ ازي في س بيل للا و ال م ك ات ب ال ذي ي ريد األ د ا ء "ه ر ي ر ة ق ال ق ال ر س ول للا صلى هللا عليه وسلم "و الن اكح ال ذي ي ريد الت ع ف ف Abu Hurairah هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, there are three who are all entitled to Allah s help; (i) the one who fights in the cause of Allah, (ii) the Mukatab who wants to pay for his freedom, and (iii) the one who gets married seeking chastity. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 8 ح د ث ن ا أ ب و ك ر ي ب ح د ث ن ا ع ب د للا ب ن ن م ي ر و م ح م د ب ن ف ض ي ل ع ن ح ج اج ع ن ع م رو ب ن ش ع ي ب ع ن أ بيه ع ن ج ده ق ال ق ا ل ر س ول للا صلى هللا عليه وسلم " أ ي م ا ع ب د ك وتب ع ل ى مائ ة أ وقي ة ف أ د اه ا إال ع ش ر أ وقي ات ف ه و ر قي ق ". 3
صلى هللا ( Allah Amr bin Shu'aib narrated from his father, from his grandfather that the Apostle of said, any slave who has made a contract to buy his freedom for one hundred (عليه و آله وسلم Uqiyyah and pays it all except ten Uqiyyah; he is still a slave. (One Uqiyyah is equal to 40 Dirhams.) Sunan Ibn Majah Vol 3, Bk 19, Hadith # 9 ح د ث ن ا أ ب و ب ك ر ب ن أ بي ش ي ب ة ح د ث ن ا س ف ي ان ب ن ع ي ي ن ة ع ن الز ه ري ع ن ن ب ه ان - م و ل ى أ م س ل م ة - ع ن أ م س ل م ة أ ن ه ا أ خ ب ر ت ع ن الن بي صلى هللا عليه وسلم أ ن ه ق ال " إذ ا ك ان إلح د اك ن م ك ات ب و ك ان عن د ه م ا ي ؤ دي ف ل ت ح ت جب من ه ". صلى هللا عليه و آله ( Prophet narrated that the (رضئ هللا تعالی عنہا ( Salamah Ummul Momineen Umm said, if anyone of you (women) has a Mukatab, and he has enough (wealth) to pay off (his (وسلم contract of manumission), she must veil herself from him. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 10 ح د ث ن ا أ ب و ب ك ر ب ن أ بي ش ي ب ة و ع لي ب ن م ح م د ق اال ح د ث ن ا و كيع ع ن هش ام ب ن ع ر و ة ع ن أ بيه ع ن ع ائش ة ز و ج الن بي صلى هللا عليه وسلم أ ن ب رير ة أ ت ت ه ا و هي م ك ات ب ة ق د ك ات ب ه ا أ ه ل ه ا ع ل ى تس ع أ و اق ف ق ال ت ل ه ا إن ش اء أ ه ل ك ع د د ت ل ه م ع د ة و احد ة و ك ان ال و ال ء لي ق ال ف أ ت ت أ ه ل ه ا ف ذ ك ر ت ذ لك ل ه م ف أ ب و ا إال أ ن ت ش ت رط ال و ال ء ل ه م ف ذ ك ر ت ع ائش ة ذ لك للن بي صلى هللا عليه وسلم ف ق ا ل " اف ع لي ". ق ال ت ف ق ام الن بي صلى هللا عليه وسلم ف خ ط ب الن اس ف ح مد للا و أ ث ن ى ع ل ي ه ث م ق ا ل " م ا ب ال رج ال ي ش ت رط ون ش ر وط ا ل ي س ت في كت اب للا ك ل ش ر ط ل ي س في كت اب للا ف ه و ب اطل و إن ك ان مائ ة ش ر ط كت اب للا أ ح ق و ش ر ط للا أ و ث ق و ال و ال ء لم ن أ ع ت ق ". رضئ ( Aisha Hisham bin Urwah narrated from his father that Barirah came to Ummul Momineen with the Muktabah from her masters who had written a contract of manumission for (هللا تعالی عنہا nine Uqiyyah. Ummul Momineen Aisha هللا تعالی عنہا) (رضئ said, if your masters wish I will pay them that in one sum, and the right of inheritance will belong to me. So, she went to her masters and told them about that, but they insisted that the right of inheritance should belong to them. (صلى هللا عليه و آله وسلم) mentioned that to the Prophet (رضئ هللا تعالی عنہا ( Aisha Ummul Momineen and he said, 'do it (buy her for manumission).' Then the Prophet هللا عليه و آله وسلم) (صلى stood up and addressed the people. He praised and glorified Allah ( و ج ل,(ع ز then he said, 'what is the?(ع ز و ج ل ( Allah matter with some people who stipulated conditions that are not in the Book of Every condition that is not in the Book of Allah ( و ج ل (ع ز is invalid, even if there are one hundred conditions. The Book of Allah ( و ج ل (ع ز is more deserving of being followed and the conditions of Allah ( و ج ل (ع ز are more binding. And the Wala belongs to the one who manumits (the slave). 4
CHAPTER (4) ب اب ال عت ق Manumission Sunan Ibn Majah Vol 3, Bk 19, Hadith # 11 ح د ث ن ا أ ب و ك ر ي ب ح د ث ن ا أ ب و م ع اوي ة ع ن األ ع م ش ع ن ع م رو ب ن م ر ة ع ن س الم ب ن أ بي ال ج ع د ع ن ش ر ح بيل ب ن السم ط ق ال ق ل ت لك ع ب ي ا ك ع ب ب ن م ر ة ح دث ن ا ع ن ر س ول للا صلى هللا عليه وسلم و اح ذ ر. ق ال س مع ت ر س ول للا صلى هللا عليه وسلم ي ق ول " م ن أ ع ت ق ام ر أ م س لم ا ك ان فك اك ه من الن ار ي ج زئ بك ل ع ظ م من ه ع ظ م من ه و م ن أ ع ت ق ام ر أ ت ي ن م س لم ت ي ن كان ت ا فك اك ه من الن ار ي ج ز ئ بك ل ع ظ م ي ن من ه م ا ع ظ م من ه ". Shurahbil bin Simt narrated that he requested Ka'b bin Murrah هللا تعالی عنہ) (رضئ to tell us a Hadith from the Apostle of Allah هللا عليه و آله وسلم) (صلى but be careful. He said, I heard the Apostle of Allah هللا عليه و آله وسلم) (صلى say, whoever frees a Muslim man, he will be his ransom from the Fire; each of his bones will suffice (as a ransom) for each of his bones. Whoever frees two Muslim women, they will be his ransom from the Fire; each of their two bones will suffice (as a ransom) for each of his bones. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 12 ح د ث ن ا أ ح م د ب ن سن ان ح د ث ن ا أ ب و م ع اوي ة ح د ث ن ا هش ام ب ن ع ر و ة ع ن أ بيه ع ن أ بي م ر اوح ع ن أ بي ذ ر ق ال ق ل ت ي ا ر س ول للا أ ى الرق اب أ ف ض ل ق ال " أ ن ف س ه ا عن د أ ه له ا و أ غ ال ه ا ث م ن ا ".,(صلى هللا عليه و آله وسلم) narrated that he said, O' Apostle of Allah (رضئ هللا تعالی عنہ) Abu Dharr which slave is best?' He said, the one who is most precious to his master and most valuable in price. CHAPTER (5) ب اب م ن م ل ك ذ ا ر حم م ح ر م ف ه و ح ر If a person becomes master of a Mahram, then he becomes free 5
Sunan Ibn Majah Vol 3, Bk 19, Hadith # 13 ح د ث ن ا ع ق ب ة ب ن م ك ر م و إس ح اق ب ن م ن ص ور ق اال ح د ث ن ا م ح م د ب ن ب ك ر ال ب ر س اني ع ن ح م اد ب ن س ل م ة ع ن ق ت اد ة و ع اصم ع ن ال ح س ن ع ن س م ر ة ب ن ج ن د ب ع ن الن بي صلى هللا عليه وسلم ق ا ل " م ن م ل ك ذ ا ر حم م ح ر م ف ه و ح ر ". Samurah bin Jundub هللا تعالی عنہ) (رضئ narrated that the Prophet (ﷺ) said, whoever becomes the master of a Mahram relative (with whom marriage is not lawful), he becomes free. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 14 ح د ث ن ا ر اشد ب ن س عيد الر م لي و ع ب ي د للا ب ن ال ج ه م األ ن م اطي ق اال ح د ث ن ا ض م ر ة ب ن ر بيع ة ع ن س ف ي ان ع ن ع ب د للا ب ن دين ار ع ن اب ن ع م ر ق ال ق ال ر س ول للا صلى هللا عليه وسلم " م ن م ل ك ذ ا ر حم م ح ر م ف ه و ح ر ". Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, whoever becomes the master of a Mahram relative, he becomes free. CHAPTER (6) ب اب م ن أ ع ت ق ع ب د ا و اش ت ر ط خد م ت ه Whoever frees a slave but stipulates that he should serve him Sunan Ibn Majah Vol 3, Bk 19, Hadith # 15 ح د ث ن ا ع ب د للا ب ن م ع اوي ة ال ج م حي ح د ث ن ا ح م اد ب ن س ل م ة ع ن س عيد ب ن ج م ه ان ع ن س فين ة أ بي ع ب د الر ح م ن ق ال أ ع ت ق ت ني أ م س ل م ة. و اش ت ر ط ت ع ل ى أ ن أ خ د م الن بي صلى هللا عليه وسلم م ا ع ا ش (رضئ هللا تعالی عنہا) Safinah Abu Abdur Rahman narrated that Ummul Momineen Umm Salama freed me but stipulated that I should serve the Prophet هللا عليه و آله وسلم) (صلى as long he lived. 6
CHAPTER (7) ب اب م ن أ ع ت ق شر ك ا ل ه في ع ب د Whoever frees his share of a slave Sunan Ibn Majah Vol 3, Bk 19, Hadith # 16 ح د ث ن ا أ ب و ب ك ر ب ن أ بي ش ي ب ة ح د ث ن ا ع لي ب ن م س هر و م ح م د ب ن بش ر ع ن س عيد ب ن أ بي ع ر وب ة ع ن ق ت اد ة ع ن الن ض ر ب ن أ ن س ع ن ب شير ب ن ن هيك ع ن أ بي ه ر ي ر ة ق ال ق ال ر س ول للا صلى هللا عليه وسلم " م ن أ ع ت ق ن صيب ا ل ه في م م ل وك أ و شق ص ا ف ع ل ي ه خ ال ص ه من م اله إن ك ان ل ه م ال ف إ ن ل م ي ك ن ل ه م ال اس ت س عي ال ع ب د في قيم ته غ ي ر م ش ق وق ع ل ي ه ". Abu Huraira هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, whoever frees his share of a slave or part of his share, must pay from his wealth if he has any wealth (in order to buy the rest of the slave s freedom). If he does not have enough wealth, then the slave should be asked to work for the price (of his freedom) without causing him too much hardship. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 16 ح د ث ن ا ي ح ي ى ب ن ح كيم ح د ث ن ا ع ث م ان ب ن ع م ر ح د ث ن ا م الك ب ن أ ن س ع ن ن افع ع ن اب ن ع م ر ق ال ق ال ر س ول للا صلى هللا عليه وسلم " م ن أ ع ت ق شر ك ا ل ه في ع ب د أ قيم ع ل ي ه بقيم ة ع د ل ف أ ع ط ى ش ر ك اء ه حص ص ه م إن ك ان ل ه من ال م ال م ا ي ب ل غ ث م ن ه و ع ت ق ع ل ي ه ال ع ب د و إال ف ق د ع ت ق من ه م ا ع ت ق ". Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, whoever wants to give his share for the freedom of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price) if he has enough wealth to do so. Otherwise, he will have freed whatever he freed. CHAPTER (8) ب اب م ن أ ع ت ق ع ب د ا و ل ه م ال One who frees a slave who has some wealth 7

Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, whoever frees a slave who has some wealth, the slave's wealth belongs to the slave, unless the master stipulates that it will belong to him. One of the narrators, Ibn Lahiah said (in his narration), unless the master makes an exception for that. Sunan Ibn Majah Vol 3, Bk 19, Hadith # 18 ح د ث ن ا م ح م د ب ن ي ح ي ى ح د ث ن ا س عيد ب ن م ح م د ال ج ر مي ح د ث ن ا ال م ط لب ب ن زي اد ع ن إس ح اق ب ن إب ر اهيم ع ن ج ده ع م ي ر - و ه و م و ل ى اب ن م س ع ود - أ ن ع ب د للا ق ال ل ه ي ا ع م ي ر إني أ ع تق ك عت ق ا ه نيئ ا إني س مع ت ر س ول للا صلى هللا عليه وسلم ي ق و ل " أ ي م ا ر ج ل أ ع ت ق غ ال م ا و ل م ي س م م ال ه ف ال م ال ل ه ". ف أ خ بر ني م ا م ال ك. Ishaq bin Ibrahim narrated from his grandfather Umair, who was the freed slave of Ibn Mas'ud said to him, O Umair, I have set you free in a (رضئ هللا تعالی عنہ) that Abdullah,(رضئ هللا تعالی عنہ) good way. I heard the Apostle of Allah هللا عليه و آله وسلم) (صلى say, 'any man who frees a slave and does not say anything about his (the slave's) wealth, it belongs to him (the slave).' So, tell me, how much wealth do you have? He said, two sandals in which I wage Jihad are better than freeing an illegitimate child. This Hadith is Dha eef.
