6 anything?' He said, 'no.' he said, (then) how come he told the Muslims to make wills?' Malik narrated that Talhah bin Musarrif reported, 'Huzail bin Shurahbil said, Abu Bakr was granted leadership according to the will of Allah's Apostle هللا عليه و آله وسلم)?(صلى (Rather) Abu Bakr هللا تعالی عنہ) (رضئ wished that he found a covenant (in that regard) from Allah's Apostle ring. so he could fetter his nose with a (camel's) nose,(صلى هللا عليه و آله وسلم) Explanation Apparently, there was no will, and that Abu Bakr ( هللا تعالی عنہ (رضئ had to accept the leadership in an emergency without ever wishing for it. If there was a will ordering Ali ( هللا تعالی عنہ (رضئ to,(رضئ هللا تعالی عنہ ( Bakr be the leader, as claimed by the followers of Shia sect, then not only Abu but all other Sahabah would have been pleased to follow him. It was impossible that if the Prophet هللا عليه و آله وسلم) (صلى had appointed Ali ( هللا تعالی عنہ (رضئ as صلى ( Prophet could have dared to deny the orders of the (رضئ هللا تعالی عنہ ( Bakr his Caliph, Abu He would have loved to go to any extent to obey the Caliph appointed by the.(هللا عليه و آله وسلم.(صلى هللا عليه و آله وسلم) Prophet Sunan Ibn Majah Vol 3, Bk 22, Hadith # 4 ح دهث ن ا أ ح م د ب ن ال م ق د ام ح دهث ن ا ال م ع ت م ر ب ن س ل ي م ان س م ع ت أ ب ي ي ح د ث ع ن ق ت اد ة ع ن أ ن س ب ن م ال ك ق ال ك ان ت ع ا همة و ص يه ة ر س ول ه للا صلى هللا عليه وسلم ح ين ح ض ر ت ه ال و ف اة و ه و ي غ ر غ ر ب ن ف س ه " ال هصال ة و م ا م ل ك ت أ ي م ان ك م ". (صلى هللا عليه و آله وسلم) narrated that what the Apostle of Allah (رضئ هللا تعالی عنہ) Anas bin Malik emphasized till his last breath was the prayer and good treatment of the slaves. 7 CHAPTER (2) ب اب ال ح ث ع ل ى ال و ص يهة The emphasis to make a will Sunan Ibn Majah Vol 3, Bk 22, Hadith # 6 ح دهث ن ا ع ل ي ب ن م ح همد ح دهث ن ا ع ب د ه للا ب ن ن م ي ر ع ن ع ب ي د ه للا ب ن ع م ر ع ن ن اف ع ع ن اب ن ع م ر ق ال ق ال ر س ول ه للا صلى هللا عليه وسلم " م ا ح ق ام ر ئ م س ل م أ ن ي ب يت ل ي ل ت ي ن و ل ه ش ىء ي وص ي ف يه إ اله و و ص يهت ه م ك ت وب ة ع ن د ه ". Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, the Muslim man has no right to spend two nights without having a written will with him, if he has something for which a will should be made. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 8 ح دهث ن ا م ح همد ب ن ال م ص فهى ال ح م ص ي ح دهث ن ا ب ق يهة ب ن ال و ل يد ع ن ي ز يد ب ن ع و ف ع ن أ ب ي الز ب ي ر ع ن ج اب ر ب ن ع ب د ه للا ق ال ق ا ل ر س ول ه للا صلى هللا عليه وسلم " م ن م ات ع ل ى و ص يهة م ات ع ل ى س ب يل و س نهة و م ات ع ل ى ت ق ى و ش ه اد ة و م ات م غ ف ور ا ل ه ". (صلى هللا عليه و آله وسلم) narrated that the Apostle of Allah (رضئ هللا تعالی عنہ) Jabir bin Abdullah said, whoever dies leaving a will, he dies on the right path and Sunnah, and he dies with piety and witness, and he dies forgiven. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 9 ح دهث ن ا م ح همد ب ن م ع م ر ح دهث ن ا ر و ح ب ن ع و ف ع ن ن اف ع ع ن اب ن ع م ر ع ن النهب ي صلى هللا عليه وسلم ق ا ل " م ا ح ق ام ر ئ م س ل م ي ب يت ل ي ل ت ي ن و ل ه ش ى ء ي وص ي ب ه إ اله و و ص يهت ه م ك ت وب ة ع ن د ه ". 3

8 Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Prophet هللا عليه و آله وسلم),(صلى the Muslim man has no right to spend two nights without having a written will with him, if he has something for which will should be made. CHAPTER (3) ب اب ال ح ي ف ف ي ال و ص يهة Injustice in Wills Sunan Ibn Majah Vol 3, Bk 22, Hadith # 10 ح دهث ن ا س و ي د ب ن س ع يد ح دهث ن ا ع ب د ال هرح يم ب ن ز ي د ال ع م ي ع ن أ ب يه ع ن أ ن س ب ن م ال ك ق ال ق ال ر س ول ه للا صلى هللا عليه وسلم " م ن ف هر م ن م ير اث و ار ث ه ق ط ع ه للا م ير اث ه م ن ال ج نهة ي وم ال ق ي ام ة ". Anas bin Malik هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, whoever tries to avoid giving the inheritance to his heirs, Allah ( هز و ج هل (ع will deprive him of his inheritance in Paradise on the Day of Resurrection. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 11 ح دهث ن ا أ ح م د ب ن األ ز ه ر ح دهث ن ا ع ب د ال هر هزاق ب ن ه همام أ ن ب أ ن ا م ع م ر ع ن أ ش ع ث ب ن ع ب د ه للا ع ن ش ه ر ب ن ح و ش ب ع ن أ ب ي ه ر ي ر ة ق ال ق ال ر س ول ه للا صلى هللا عليه وسلم " إ هن ال هرج ل ل ي ع م ل ب ع م ل أ ه ل ال خ ي ر س ب ع ين س ن ة ف إ ذ ا أ و ص ى ح اف ف ي و ص يهت ه ف ي خ ت م ل ه ب ش ر ع م ل ه ف ي د خ ل النهار و إ هن ال هرج ل ل ي ع م ل ب ع م ل أ ه ل ال هشر س ب ع ين س ن ة ف ي ع د ل ف ي و ص يهت ه ف ي خ ت م ل ه ب خ ي ر ع م ل ه ف ي د خ ل ال ج نهة ". ق ال أ ب و ه ر ي ر ة و اق ر ء وا إ ن ش ئ ت م }ت ل ك ح د ود ه للا { إ ل ى ق و ل ه }ع ذ اب م ه ين { Abu Hurairah هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, a man may do the deeds of the people of goodness for seventy years, then when he makes his will, he is unjust in his will, so he ends (his life) with evil deeds and enters Hell. And a man may do the deeds of the people of evil for seventy years, then he is just in his will, so he ends (his life) with good deeds and enters Paradise. Abu Hurairah هللا تعالی عنہ) (رضئ said, recite, if you wish ت ل ك ح د ود ه للا و م ن ي ط ع ه للا و ر س ول ه ي د خ ل ه ج نهات ت ج ر ي م ن ت ح ت ه ا األ ن ه ار خ ال د ين ف يه ا و ذ ل ك ال ف و ز ال ع ظ ي م - م ن ي ع ص ه للا [These are the limits set by Allah, and those who و ر س ول ه و ي ت ع ده ح د ود ه ي د خ ل ه ن ار ا خ ال د ا ف يه ا و ل ه ع ذ اب م ه ين follow the commandments of Allah and His Apostle هللا عليه و آله وسلم),(صلى will indeed be admitted to gardens with streams flowing beneath, where they will abide forever; and this will be a great success. And whoever disobeys Allah and His Apostle هللا عليه و آله وسلم) (صلى and transgresses His limits, He will put him into the Fire to abide therein, and he will have a humiliating torment.] (An-Nisa 13-14). 4

9 Sunan Ibn Majah Vol 3, Bk 22, Hadith # 12 ح دهث ن ا ي ح ي ى ب ن ع ث م ان ب ن س ع يد ب ن ك ث ير ب ن د ين ار ال ح م ص ي ح دهث ن ا ب ق يهة ع ن أ ب ي ح ل ب س ع ن خ ل ي د ب ن أ ب ي خ ل ي د ع ن م ع او ي ة ب ن ق هرة ع ن أ ب يه ق ال ق ال ر س ول ه للا صلى هللا عليه وسلم " م ن ح ض ر ت ه ال و ف اة ف أ و ص ى و ك ان ت و ص يهت ه ع ل ى ك ت اب ه للا ك ان ت ك فهار ة ل م ا ت ر ك م ن ز ك ات ه ف ي ح ي ات ه ". (صلى هللا عليه و آله وسلم) Mu'awiyah bin Qurrah narrataed from his father that the Apostle of Allah said, whoever makes a will as death approaches, and his will is in accordance with the book of Allah ( هز و ج هل (ع it will be an expiation for whatever he did not pay of his Zakah during his lifetime. CHAPTER (4) ب اب النهه ي ع ن اإل م س اك ف ي ال ح ي اة و التهب ذ ير ع ن د ال م و ت The prohibition of withholding while alive, only to squander upon one s death Sunan Ibn Majah Vol 3, Bk 22, Hadith # 13 ح دهث ن ا أ ب و ب ك ر ب ن أ ب ي ش ي ب ة ح دهث ن ا ش ر يك ع ن ع م ار ة ب ن ال ق ع ق اع و اب ن ش ب ر م ة ع ن أ ب ي ز ر ع ة ع ن أ ب ي ه ر ي ر ة ق ال ج اء ر ج ل إ ل ى النهب ي صلى هللا عليه وسلم ف ق ال ي ا ر س ول ه للا ن ب ئ ن ي ب أ ح ق النهاس م ن ي ب ح س ن الص ح ب ة ف ق ا ل " ن ع م و أ ب يك ل ت ن بهأ هن أ م ك ". ق ال ث هم م ن ق ال " ث هم أ م ك ". ق ال ث هم م ن ق ال " ث هم أ م ك ". ق ال ث هم م ن ق ال " ث هم أ ب وك ". ق ال ن ب ئ ن ي ي ا ر س ول ه للا ع ن م ال ي ك ي ف أ ت ص ده ق ف يه ق ال " ن ع م و ه للا ل ت ن بهأ هن أ ن ت ص دهق و أ ن ت ص ح يح ش ح يح ت أ م ل ال ع ي ش و ت خ اف ال ف ق ر و ال ت م ه ل ح تهى إ ذ ا ب ل غ ت ن ف س ك ه اه ن ا ق ل ت م ال ي ل ف ال ن و م ال ي ل ف ال ن و ه و ل ه م و إ ن ك ر ه ت ". (صلى هللا عليه و آله وسلم) narrated that a man came to the Prophet (رضئ هللا تعالی عنہ) Abu Hurairah and said, O Apostle of Allah هللا عليه و آله وسلم),(صلى tell me, which of the people has most right to my good companionship?' He said, you will certainly be told. (The first preference among your parents is) your mother,' He asked, 'then who?' He said, then your mother.' He asked, then who?' He said, then your mother.' (The fourth time) he asked, then who?' He said, then your father.' He asked, 'tell me, O Apostle of Allah هللا عليه و آله وسلم) (صلى about my wealth; how should I give in charity?' He said, 'yes, by Allah ( هز و ج هل (ع you will certainly be told. You should give in charity when you are still healthy and greedy for wealth, hoping for a long life and fearing poverty. Do not stay until your soul reaches the end of your life and you say, my wealth of for so-and-so, and for so-and-so, and it will be for them even though you dislike that. 5

10 Sunan Ibn Majah Vol 3, Bk 22, Hadith # 14 ح دهث ن ا أ ب و ب ك ر ب ن أ ب ي ش ي ب ة ح دهث ن ا ي ز يد ب ن ه ار ون أ ن ب أ ن ا ح ر يز ب ن ع ث م ان ح دهث ن ي ع ب د ال هرح من ب ن م ي س ر ة ع ن ج ب ي ر ب ن ن ف ي ر ع ن ب س ر ب ن ج هحاش ال ق ر ش ي ق ال ب ز ق النهب ي صلى هللا عليه وسلم ف ي ك ف ه ث هم و ض ع أ ص ب ع ه ال هسبهاب ة و ق ا ل " ي ق ول ه للا ع هز و ج هل أ نهى ت ع ج ز ن ي اب ن آد م و ق د خ ل ق ت ك م ن م ث ل ه ذ ه ف إ ذ ا ب ل غ ت ن ف س ك ه ذ ه - و أ ش ار إ ل ى ح ل ق ه - ق ل ت أ ت ص دهق و أ نهى أ و ان ال هصد ق ة ". (صلى هللا عليه و آله وسلم) narrated that the Prophet (رضئ هللا تعالی عنہ) Busr bin Jahhash Al-Quraishi spat in his palm then pointed to it with his index finger and said, Allah ( هز و ج هل (ع says, 'do you think you can escape from My punishment, O son of Adam, when I have created you from something like this? When your soul reaches here' - and (the Prophet (ﷺ pointed to his throat - 'you say: I give charity.' But it is too late for charity? CHAPTER (5) ب اب ال و ص يهة ب الث ل ث Making a will for 1/3 rd Sunan Ibn Majah Vol 3, Bk 22, Hadith # 15 ح دهث ن ا ه ش ام ب ن ع همار و ال ح س ي ن ب ن ال ح س ن ال م ر و ز ي و س ه ل ق ال وا ح دهث ن ا س ف ي ان ب ن ع ي ي ن ة ع ن الز ه ر ي ع ن ع ام ر ب ن س ع د ع ن أ ب يه ق ال م ر ض ت ع ام ال ف ت ح ح تهى أ ش ف ي ت ع ل ى ال م و ت ف ع اد ن ي ر س ول ه للا صلى هللا عليه وسلم ف ق ل ت أ ى ر س ول ه للا إ هن ل ي م اال ك ث ير ا و ل ي س ي ر ث ن ي إ اله اب ن ت ي أ ف أ ت ص دهق ب ث ل ث ى م ال ي ق ال " ال ". ق ل ت ف ال هشط ر ق ال " ال ". ق ل ت ف الث ل ث ق ا ل " الث ل ث و الث ل ث ك ث ير إ نهك أ ن ت ت ر ك و ر ث ت ك أ غ ن ي اء خ ي ر م ن أ ن ت ت ر ك ه م ع ال ة ي ت ك فهف ون النهاس ". Amir bin Sa'd narrated from his father that he became sick during the year of the Conquest and was at death's door. The Apostle of Allah هللا عليه و آله وسلم) (صلى came to see me, and I said, 'O Apostle of Allah هللا عليه و آله وسلم),(صلى I have a great deal of wealth and no one will inherit from me apart from my daughter. Can I give two thirds of my wealth in charity?' He said, 'no.' I said, 'then half?' He said, 'no.' I said, 'one third?' He said, one third and one third is a lot. If you leave your heirs rich that is better than leaving them destitute and begging from people. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 16 ح دهث ن ا ع ل ي ب ن م ح همد ح دهث ن ا و ك يع ع ن ط ل ح ة ب ن ع م ر و ع ن ع ط اء ع ن أ ب ي ه ر ي ر ة ق ال ق ال ر س ول ه للا صلى هللا عليه وسلم " إ هن ه للا ت ص دهق ع ل ي ك م ع ن د و ف ات ك م ب ث ل ث أ م و ال ك م ز ي اد ة ل ك م ف ي أ ع م ال ك م ". 6

11 Abu Huraira هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, Allah ( هز و ج هل (ع has been charitable with you over the disposal of one third of your wealth at the time of your death, so that you may be able to add to the record of your good deeds. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 17 ح دهث ن ا ص ال ح ب ن م ح همد ب ن ي ح ي ى ب ن س ع يد ال ق هطان ح دهث ن ا ع ب ي د ه للا ب ن م وس ى أ ن ب أ ن ا م ب ار ك ب ن ح هسان ع ن ن اف ع ع ن اب ن ع م ر ق ا ل ق ال ر س ول ه للا صلى هللا عليه وسلم " ي ا اب ن آد م اث ن ت ان ل م ت ك ن ل ك و اح د ة م ن ه م ا ج ع ل ت ل ك ن ص يب ا م ن م ال ك ح ين أ خ ذ ت ب ك ظ م ك أل ط ه ر ك ب ه و أ ز ك ي ك و ص ال ة ع ب اد ي ع ل ي ك ب ع د ان ق ض اء أ ج ل ك ". Ibn Umar هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى said, (Allah says) O son of Adam السالم),(عليه I have given you two things which you do not deserve, I allow you to dispose of a share of your wealth when you are on your deathbed, in order to cleanse and purify you, and my servants pray for you after your life is over. Sunan Ibn Majah Vol 3, Bk 22, Hadith # 18 ح دهث ن ا ع ل ي ب ن م ح همد ح دهث ن ا و ك يع ع ن ه ش ام ب ن ع ر و ة ع ن أ ب يه ع ن اب ن ع بهاس ق ال و د د ت أ هن النهاس غ ض وا م ن الث ل ث إ ل ى الر ب ع أل هن ر س ول ه للا صلى هللا عليه وسلم ق ال " الث ل ث ك ب ير - أ و ك ث ير - ". Ibn Abbas هللا تعالی عنہ) (رضئ said, I would like the people to reduce (the will) from one third to one quarter, because the Apostle of Allah هللا عليه و آله وسلم) (صلى said, 'one third is a lot. 12 Amr bin Kharijah ( هللا تعالی عنہ (رضئ narrated that the Prophet هللا عليه و آله وسلم) (صلى addressed them when he was on his camel. His camel was chewing its cud and its saliva was dripping between my shoulders. He said, 'Allah ( هز و ج هل (ع has allocated for each heir his share of the inheritance, so it is not permissible (to make) a bequest for an heir. The child belong to the bed and the adulterer gets the stone. Whoever claims to belong to someone other than his father, or (a freed slave) who claims that his Wala is for other than his Mavali, upon him will be the curse of Allah, the angels and all the people, and no charge nor equitable exchange will be accepted from him. Or he said, no equitable exchange nor change. Shurahbil bin Muslim Al-Khawlani narrated from Abu Umamah Al-Bahili هللا تعالی عنہ) (رضئ that the heard the Apostle of Allah هللا عليه و آله وسلم) (صلى say in his sermon during the year of the Farewell pilgrimage, Allah ( هز و ج هل (ع has given each person who has rights, his rights, and there is no (need of a will) in heritance (for the heirs). Anas bin Malik ( هللا تعالی عنہ (رضئ narrated that he was sitting under the she-camel of the Apostle of Allah هللا عليه و آله وسلم) (صلى and its saliva was dripping between my shoulders, and I heard him say, 'Allah ( هز و ج هل (ع has given each person who has rights, his rights, but there is no bequest for an heir. Explanation From the wealth of the deceased, first, the expenditure of shrouding and burial are deducted. After making the payment of debt from the remaining property, whatever is left, one third is paid as per to the will, and then the remaining is distributed among the heirs. 8

13 CHAPTER (7) ب اب الدهي ن ق ب ل ال و ص يهة Debt before the will Sunan Ibn Majah Vol 3, Bk 22, Hadith # 21 ح دهث ن ا ع ل ي ب ن م ح همد ح دهث ن ا و ك يع ح دهث ن ا س ف ي ان ع ن أ ب ي إ س ح اق ع ن ال ح ار ث ع ن ع ل ي ق ال ق ض ى ر س ول ه للا صلى هللا عليه وسلم ب الدهي ن ق ب ل ال و ص يهة و أ ن ت م ت ق ر ء ون ه ا }م ن ب ع د و ص يهة ي وص ي ب ه ا أ و د ي ن } و إ هن أ ع ي ان ب ن ي األ م ل ي ت و ار ث ون د ون ب ن ي ال ع اله ت. Ali هللا تعالی عنہ) (رضئ narrated that the Apostle of Allah هللا عليه و آله وسلم) (صلى ruled that the debts م ن ب ع د و ص يهة ي وص ي ب ه ا أ و د ي ن verse should be paid off before the execution of the will. Recite this [The distribution in all cases is) after the payment of legacies he may have bequeathed or debts.] (An-Nisa 11). The sons of the same mother (and father) inherit from one another, but not the sons of different mothers (but same father). CHAPTER (8) ب اب م ن م ات و ل م ي وص ه ل ي ت ص دهق ع ن ه If a person dies without having made a will, can charity be given on his behalf? Sunan Ibn Majah Vol 3, Bk 22, Hadith # 22 ح دهث ن ا أ ب و م ر و ان م ح همد ب ن ع ث م ان ال ع ث م ان ي ح دهث ن ا ع ب د ال ع ز يز ب ن أ ب ي ح از م ع ن ال ع ال ء ب ن ع ب د ال هرح م ن ع ن أ ب يه ع ن أ ب ي ه ر ي ر ة أ هن ر ج ال س أ ل ر س ول ه للا صلى هللا عليه وسلم ق ال إ هن أ ب ي م ات و ت ر ك م اال و ل م ي وص ف ه ل ي ك ف ر ع ن ه أ ن ت ص دهق ت ع ن ه ق ال " ن ع م ". صلى هللا عليه و آله ( Allah narrated that a man asked the Apostle of (رضئ هللا تعالی عنہ) Abu Huraira my father died and left behind wealth, but he did not make a will. I think that if she (و آله وسلم could have spoken, she would have given in charity. Will she have a reward if I give charity on her behalf, and will I also have a reward? He said, yes. CHAPTER (9) ب اب ق و ل ه : }و م ن ك ان ف ق ير ا ف ل ي أ ك ل ب ال م ع ر وف } Allah ( هز و ج هل (ع statement [And he who is poor should use only as much as is fair] (An-Nisa 6) Sunan Ibn Majah Vol 3, Bk 22, Hadith # 24 ح دهث ن ا أ ح م د ب ن األ ز ه ر ح دهث ن ا ر و ح ب ن ع ب اد ة ح دهث ن ا ح س ي ن ال م ع ل م ع ن ع م ر و ب ن ش ع ي ب ع ن أ ب يه ع ن ج د ه ق ال ج اء ر ج ل إ ل ى النهب ي صلى هللا عليه وسلم ف ق ال ال أ ج د ش ي ئ ا و ل ي س ل ي م ال و ل ي ي ت يم ل ه م ال ق ا ل " ك ل م ن م ال ي ت يم ك غ ي ر م س ر ف و ال م ت أ ث ل م اال ق ال و أ ح س ب ه ق ال " و ال ت ق ي م ال ك ب م ال ه Amr bin Shu'aib هللا تعالی عنہ) (رضئ narrated from his father, that his a grandfather said, a man came to the Prophet هللا عليه و آله وسلم) (صلى and said, 'I do not have anything and I have no wealth, but I have an orphan (under my care) who has wealth. He said, eat from the wealth of your orphan, without being extravagant or use it for trade. He (narrator) said, and I think he said, 'do not preserve your wealth using his instead.' 10
